Senate Bill 543, sign by the California State Governor in October 2010, creates a new minor consent mental health right in California (THL). The Mental Health Services for At-Risk Youth Act provides youth, ages 12 and older, the ability to consent to mental health treatment without parental consent provided they are fester enough to intelligently participate in treatment (THL).
Mental Health Services for At-Risk Youth Act is still a new law on the books for the mental health counselor; however, the impact on the counseling profession does have its challenges. It is cognize that instead of focusing on crisis management once a mental health situation has already becomes life enceinte the new law emphasizes prevention and early detection, which are much effective and less costly for health care providers (Maza, 2010)
In reading the Keeping Children and Families Safe act of 2003, it was identified as a very complex and multi-functional tool to protect electric shaverren. This act, at once known as Child Abuse Prevention and give-and-take Act (CAPTA) was renamed the Keeping Children Safe Act of 2003 (Eford, p. 85).
A flip-flop to this Act that I identified as crucial to the counseling profession is the mandate to report suspected child abuse. As someone who is familiar with this mandate, I realize the seriousness of reporting and not reporting suspected child abuse. It would seem consistent that a counselor who works with children would need to take the unavoidable steps to be able to identify suspected child abuse. The absence of reporting suspected child abuse could have severe consequences for the counselor. Penalties may include loss of certificate or license, disciplinary action, or termination of employment (Eford, p. 85).
